Version 2026-10-23.3 · published Oct 23, 2026
Version 2026-10-23.3. These Terms are the agreement between you and Hire a Neighbor for the service at hireneighbor.app. Hire a Neighbor is the name of the service. Support, privacy requests, and legal notices go to hire.neighbor.os@gmail.com. No postal address is designated for this version. Email to that address is the notice channel.
Hire a Neighbor is a place where people find each other and keep a record. We are not a party to your deal. We do not come to the job, employ either of you, supervise the work, control how it is done, or insure anyone.
In-person work can injure someone, damage property, fail, or go unpaid. You choose the person, the place, and the terms. Those risks belong to the people in the deal.
To the extent the law allows, you release Hire a Neighbor and the people who work on the service from claims arising out of another person's acts or omissions, the work, a place or a thing, travel, a tool or animal, or a payment that runs between you and another person. You will defend us and pay our direct losses and reasonable legal costs if a claim is brought against us because of your content, your conduct, the way you hold yourself out, your taxes, your licenses, your insurance, or an injury or loss in work you do or hire.
If we are liable for the tool itself and the law allows a limit, that limit is the greater of the amount you paid us for the service in the twelve months before the claim, or one hundred U.S. dollars. The limit covers direct damages only. To the extent the law allows, we are not liable for lost profits, lost goodwill, lost data, or indirect or consequential loss.
Montana Code Annotated 28-2-702 makes a contract void when its object is to exempt anyone from responsibility for that person's own fraud, for willful injury to the person or property of another, or for violation of law, whether willful or negligent. Nothing in these Terms is a waiver of that statute, of our fraud, or of a remedy the law says a contract cannot waive. Every limit, release, and indemnity in these Terms yields to that sentence.
These Terms cover the service as a whole. They are written so the parts below can be made available without changing this bargain. The parts are accounts, invitations, listings, requests, messages, proposals, scheduling, workspaces, cooperation with people you choose, direct bills of sale, reviews, shipping, card payments, payouts, cash and in-kind records, and the Neighbor assistant.
A part applies when the service makes it available to you. The screen that asks you to confirm a charge, a shipment, a signature, or an instruction to Neighbor is the specific step you are accepting. An estimate, a draft, or a listing is not that step.
A youth or guardian account is not offered under this version. Offering one requires its own published terms.
You must be old enough to make a contract in the state where you live, and at least 18. That age is 19 if you live in Alabama or Nebraska, and 21 if you live in Mississippi. It is 18 in the District of Columbia and in every other state. If the statute where you live sets a different age, that age controls. You give a true email address, display name, birth date, and home state, and you keep your sign-in methods to yourself. Tell us if someone else gets into the account, and tell us when your home state changes. A person in your household does not share your account.
When invitation is required, an account opens only with a valid invitation. An invitation is not a promise of work, income, or a completed agreement. You may deal with a neighbor outside the service. These Terms do not charge an exit fee and do not require exclusivity.
You are not our employee, partner, agent, or joint venturer. We are not your fiduciary. The other person in a deal is not our employee either. You are responsible for your own licenses, permits, insurance, tools, taxes, and for whether your deal with another person is employment under the law that applies. Do not tell anyone that you work for Hire a Neighbor, that we vetted you, or that we insure you. A label in the product means only the check it names.
You choose what to offer, request, and agree to. Describe the work or goods honestly, including scope, condition, timing, price, and the area. Offer only what you have authority to provide. Follow the law of the place where the activity happens, including a city, county, or tribal rule that applies there. A category label in the product is not a ruling that the activity is lawful.
A listing, request, or suggestion is not itself a deal. A deal is formed when the people agree to the terms the product records for that agreement. Read the parties, scope, timing, cancellation, and payment terms before you confirm. The people in the deal perform it. We supply the record and the tools. We do not promise another person's quality, license, insurance, presence, or payment.
Where the service offers a direct deal, both people sign the bill of sale in the product. That record does not, by itself, move money through us.
Where the service offers reviews, say what you believe is true. Do not review yourself or trade a review for payment. A review is about the deal. It is not a statement by us.
The confirmation screen states every amount you pay or receive for that action, including any fee. That screen is the charge. Do not confirm an amount you do not accept. Our operating rule is that every order covers its conservative all-in cost. We do not add a charge the screen did not show.
Cash, in-kind exchange, and a tab are ways to record an agreement. A tab record does not itself move money.
When card payments or payouts are available, the named payment provider processes them under its terms and the confirmation screen. We do not hold a stored balance of your money. We are not a bank, and we are not an escrow holder. Recording an agreement does not insure anyone and does not guarantee a refund. A cancellation or refund term is the one shown before you confirm, together with any right the law does not let a contract remove.
You handle your own taxes. Montana has no general statewide sales tax. A lodging tax or a local resort tax can still apply to a particular transaction, and income you earn is yours to report. A tax form from a payment provider reports gross payments under the rule for that rail. Reconcile it with your own records. We do not give tax advice.
When the service offers shipping, the confirmation screen shows the carrier, the price, and what is being shipped before a label is purchased. You are responsible for lawful contents and for an accurate destination. A rate quote is not a purchased label until you confirm the purchase.
You are responsible for equipment-authorization and product-safety rules that apply to goods you sell, including radio devices and recalled consumer products.
Neighbor can search, draft, and propose inside the controls you set. It does not receive your private price floor. It cannot spend, book, message, or bind you unless you gave that authority in the product and the product's own checks allow the action. You can pause it and act yourself. Automated text can be wrong. It is not professional advice and it is not a check of someone's license or of safety. You remain responsible for what you approve. We are not liable for a draft you could review, or for your decision to follow it.
You represent that you have the rights to the content you submit and that it does not infringe anyone else's rights. You keep ownership of the content you submit. You give Hire a Neighbor and its service providers permission to host, store, transmit, display, and back up that content so we can operate the features and audiences you choose, keep the records of your agreements, and meet legal duties. This permission does not transfer ownership. It does not allow us to sell your personal information, to use your content for advertising to other people, or to train a general model for someone else.
We may use records to operate, secure, and fix the service. A future use of content to train a model would be a separate choice, off unless you opt in after a new notice.
A suggestion you send about the product may be used to operate and improve the product, without a duty to pay you. That does not transfer your listings, messages, photos, or workspace records.
Do not put a private street address or another person's sensitive information in a public description. Public profile fields are a first name and last initial, and the biography, skills, offerings, and reputation you choose to publish.
Do not use the service to break the law or to help someone else break it. Do not impersonate a person, threaten, harass, defraud, or discriminate unlawfully. Do not bypass account controls. Do not publish another person's private information.
Do not offer, request, or agree to any of the following through the service:
The place of the work can add a city, county, or tribal rule. You follow that rule. The product can show the name of a county or a city. That label is not a complete statement of the local ordinance.
Platform messages are not an emergency service. For an emergency, contact local emergency services.
We have no duty to review every listing, message, or profile. We may remove content, decline a transaction, or close an account to address safety, security, fraud, a legal demand, or a payment problem. We may close an account of a person who repeatedly posts material that draws a complete copyright notice. Where we can do it without adding to the harm, we will tell you what happened and you can write to hire.neighbor.os@gmail.com to challenge a mistake. A limit on an account does not erase a right the law gives you, and it does not cancel a deal you already made with another person.
If you sell new or unused consumer products on the service, federal marketplace rules can require us to collect, verify, and disclose seller information once you pass the statutory thresholds. You will provide the identity, contact, and account information those rules require, and you will certify it when asked. We disclose the information the statute requires, in the place the statute requires, when the public-disclosure threshold is met. Selling used goods that you describe as used is a different case under that statute.
If you believe content on the service infringes a copyright, send a notice to hire.neighbor.os@gmail.com or use the form at hireneighbor.app/legal/ip-complaint. A notice we can act on includes:
If we remove material, the person who posted it can send a counter-notice to the same address or to hireneighbor.app/legal/counter-notice. A counter-notice includes a signature, identification of the material and where it appeared, a statement under penalty of perjury that the sender believes the removal was a mistake or a misidentification, and the sender's name, address, and telephone number, plus consent to the jurisdiction of the federal court for that person's district and a promise to accept service from the person who sent the original notice.
We do not claim the safe harbor in 17 U.S.C. 512 until a designated agent is recorded in the United States Copyright Office directory. Notices sent to the email above are still reviewed.
The Privacy Policy of the same version is part of these Terms. It describes personal data, the reasons we use it, the people who receive it, and the requests you can make. Where the two documents disagree about personal data, the Privacy Policy controls.
You may close your account and you may ask for an export and for deletion. Closing an account stops new sign-in. It does not cancel a deal you already made, a payment that is already in motion, or a record we must keep for tax, accounting, fraud, or a legal duty. Closing an account is not a promise that every copy is gone. Backups expire on their own cycle. Another person keeps the messages and deal records they were party to. The privacy response tells you what was removed, what remains, and why.
There is no fee to export or to close an account.
The allocation in Read this first is part of these Terms and controls if another sentence is narrower.
The service is a tool. To the extent the law allows, we disclaim warranties of merchantability, fitness for a particular purpose, quiet enjoyment, and uninterrupted or error-free operation. We do not warrant another person's conduct, qualifications, identity, or performance. We do not warrant that a listing is accurate, that a person will show up, or that a message will be read in time. Keep your own copy of records you need. We are not your archive.
If a covered claim is made against us, you will take over the defense when we ask in writing, you will cooperate, and you will not settle it in a way that admits fault by us or imposes a duty on us unless we agree in writing. We may take over the defense if you do not. The indemnity does not apply to the extent the claim is caused by our fraud, our willful injury, or a violation of law that MCA 28-2-702 does not allow a contract to shift.
The sections Read this first, Dealings with other people, Money, Your content, Acceptable use, Copyright, Privacy, Limits, and Disputes survive closing an account. We may ask a court to stop a misuse of the service without proving money damages, to the extent the court allows.
The state that matters is the state that matches what you are doing.
You live in the state you treat as your home. If you actually live in two states in the same year, you live in each one while you are there. A short trip does not change your home. If you are in school or on military orders in a state, you are present in that state while you are there, and your domicile remains your home state for a privacy law that uses residence.
You work in the state where the work is performed. A job at another person's home is in that home's state. A job at a shop is in the shop's state. A meeting in a third state is a transaction in that state. Work on tribal land is also subject to that tribe's law. The District of Columbia and a US territory count as a place in the same way. A federal installation follows federal law and any state law that still reaches the act.
You shop in the state where you receive the goods or accept the work. You shop from the state where you part with the goods or set out to do the work. A digital item is received where you are when you receive it. If goods cross a state, the shipment has to be lawful where it starts, where the law reaches it in transit, and where it is delivered.
If you name the wrong state, the state where you actually live, work, or deal still applies. When you move, your home state for new activity changes. A record already created stays under the law that applied when it was created.
Federal law applies wherever it reaches.
A deal with another person is governed by the law of the state where the work is performed. For goods, the law of the state where the buyer receives them, and the law of the state they are sent from, apply to whatever those states do not allow a contract to waive.
Privacy requests follow the state where you live. The Privacy Policy states that. If more than one state's privacy law treats you as its resident, you may use each right one of those states gives you.
Licenses, safety rules, insurance, and the question of whether one person employs the other follow the state where the work is performed.
A consumer protection the law does not allow a contract to waive stays available where you live, where you receive what you bought, and where the offer was directed to you. A private right a state gives for a security breach is not waived. A cancellation right for a sale at a home, under federal or state cooling-off rules, stays with the people in that sale.
The contract between you and Hire a Neighbor about the tool is governed by Montana law. That choice does not take away a protection identified above that the law says a contract cannot take away. It does not move a case out of a court that has jurisdiction. These Terms do not require arbitration. They do not waive a jury. They do not waive a class or collective case. They do not pick a county. A claim under the Montana Consumer Protection Act keeps the procedure that statute gives an individual.
You comply with each law that regulates your own conduct where you act. An offer has to be lawful under federal law, lawful where you act, and lawful where the other person receives the goods or the work.
Taxes follow the states that claim the transaction. You handle the taxes the law assigns to you. When a payment feature is on and a state requires a marketplace to collect a tax, the confirmation screen shows that tax before you pay. A cash, barter, or tab record that does not move money through the service is not a tax we collect.
If you use the service from outside the United States, these Terms still cover the tool. We have not assessed a foreign privacy statute for your country. Do not use the service to export a good in violation of law.
Talk to us first at hire.neighbor.os@gmail.com about a problem with the service. Talk to the other person about performance of your deal with them.
If a court holds a part of these Terms unenforceable, the rest stays in effect. These Terms, the Privacy Policy of the same version, and the specific screen you confirm are the whole agreement about the service. They do not replace the deal between you and another person. You may not assign your account. We may assign these Terms in a merger or a sale of the service if the assignee takes them on. A person who is not a party does not gain rights under these Terms, except that the other person in a recorded deal can rely on that record.
We are not liable for a delay or failure of the tool caused by an event outside our reasonable control. That sentence does not excuse your promise to another person.
You agree that we may send notices about the service to the email on your account, and that electronic records and signatures in the product satisfy any rule that requires a writing or a signature, under the federal Electronic Signatures in Global and National Commerce Act and the Montana Uniform Electronic Transactions Act, MCA Title 30, chapter 18, part 1. You can still ask for a privacy response by email.
We publish changes as a new version with its own date and keep the text you accepted. We will tell you about a material change. Where a change would use personal data you already gave us for a materially different purpose, the Privacy Policy describes the chance to say no before that further use. Accepting a newer version does not rewrite the text you accepted before.
Hire a Neighbor, hireneighbor.app. Email hire.neighbor.os@gmail.com for support, privacy, copyright, and notices. No postal address is designated. Mail sent to a street address will not be received under this version.
Name where you live. Add the work state, where goods are received, or where they are sent from when you know them. A blank place is not assigned.
